1. Bob's Furniture Removal Service
Bob's Discount Furniture, LLC ("Bob's") via its independent third-party delivery providers ("Third-Party Provider(s)") are offering our customers ("you" or "your") an easy and affordable way to remove and dispose of your existing furniture during the delivery of your newly purchased Bob's furniture through this unique program (our "Removal Services").
2. Your Acknowledgments
By using the Removal Services, you acknowledge and agree that you are requesting that our Third-Party Providers provide you, at the same time of the delivery of your newly purchased Bob's furniture, with the removal and disposal of your existing furniture. Except as otherwise provided for in these Terms, you acknowledge that you are obtaining all haul-away, product disassembly, and related services at your own risk.
3. Your Representations
By using the Removal Services, you expressly warrant and represent that you have read, understood, and agree to be legally bound by these Terms; you are at least eighteen (18) years old; and own or have legal possession to any and all furniture to be hauled away, disassembled, transported, or subjected to any other services made available through these Terms.
4. Placing an Order for Removal Services
a. At the time of purchase of your new Bob's furniture you may place an order and pay in full for Removal Services. Removal Services cannot be ordered or paid for at any other time other than at the time of purchase. Removal Services cannot be ordered or modified once the delivery has been scheduled and if the Third-Party Providers are already at your location. However, you may cancel an order completely or delete an item from the order.
b. We reserve the right to refuse or cancel your order for Removal Services at our sole discretion at any time and for any reason, including without limitation availability of Removal Services, errors in the description or price of the Removal Services, other errors in your order, if fraud or an unauthorized or illegal transaction is suspected, or for any other reason.
5. Pricing for the Removal Services
The Removal Services and all associated pricing is dependent on the delivery of your new furniture from Bob's. We must deliver and you must accept at least one piece of new furniture to be eligible for Removal Services. The initial piece of furniture is $150.00 and then each additional piece of furniture is $50.00. By way of example for the removal of a sectional sofa, each piece of the sectional is a separate charge (i.e. 3-piece sectional sofa would be the initial cost plus 2 additional pieces at the additional cost for a total cost of $250.00.)
You acknowledge and understand that once the Removal Services are purchased and ordered that you cannot add on any additional pieces of furniture to be removed on the day of delivery.
6. Rescheduling & Cancelling; Refunds; Cancellation & Other Fees
a. Rescheduling Orders
The rescheduling and cancelling of Removal Services follows the same procedures as the delivery of your new furniture from Bob's. You may reschedule your Removal Services in conjunction with any rescheduling of your delivery through mybobs.com or by submitting a request via customer support at any time. You may reschedule the Removal Services at any time but they must be rescheduled to coordinate with the new rescheduled delivery of your new furniture. We will not schedule the Removal Services alone without a delivery of new furniture. At least one piece of new furniture must be delivered and accepted by you to be eligible for Removal Services.
b. Cancellations
You may cancel the Removal Services prior to the delivery date through mybobs.com and customer support by submitting a request online, by phone, or by emailing us.
c. Refunds
Refunds Due to Change in Removal Services
You are entitled to a refund for any changes to the scope of your order for the Removal Services, provided that you notify us of the change prior to your Removal Service being completed.
8. Availability and Limitations
a. Removal Services may be unavailable in your geographic area.
b. All furniture that is to be disposed of as part of the Removal Services must all be located at the same address as the delivery address. No additional stops will be made.
9. Accessibility and Disassembly
Do not place an order for Removal Services if your furniture item(s) require extensive disassembly and/or are not safely removable without the destruction of the item and/or alternation of the building and/or property that your item(s) is/are located in. By placing an order for Removal Services, you are representing to us that all items are accessible and removable from your location.
10. Refusal of Removal Service
Notwithstanding anything to the contrary in these Terms, we reserve the right to refuse or cancel the Removal Services at any time and for any reason. Without limiting our ability to cancel an order for any reason, we or our Third-Party Providers, in our sole discretion, will refuse or cancel the Removal Services due to the following circumstances:
- a. If an item is found to be infested with bugs (and if such infestation was not disclosed at the time of purchase of the Removal Service);
- b. If your item is too dangerous, toxic, unsanitary or has pieces with broken glass;
- c. We will only remove similar furniture items to those that we sell in Bob's stores, for instance we will not remove pianos, appliances, trash, televisions, etc.
- d. In instances of inclement weather such as heavy rain, snow, sleet, hail, lightning, and/or high winds;
- e. Your location is inaccessible or too far away from our Third-Party Provider's vehicle or is too dangerous or unsanitary;
- f. If your item(s) cannot be moved safely through a narrow doorway, hallway, up or down stairs. If you still want our Third-Party Provider to provide the Services after being advised of the risk of damage to your property, you waive any right to receive any reimbursement or other recompense for any damages that may result.
11. Disposal of Items
Disposed furniture that is removed from your location is not able to be returned to you. We do not track disposed items. Any personal items left in the disposed items cannot be returned to you and you are responsible for ensuring that all personal property is removed from the furniture prior to the delivery date. Bob's and its Third-Party Providers are not liable for any personal property left in the disposed furniture.
